These Terms and Conditions govern your use of the website located at napaconcretecontractor.com and any services provided by Napa Concrete.
By accessing or using this website, requesting a service estimate, or entering into a service agreement with Napa Concrete, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or request our services.
These terms apply to all visitors to our website and to all customers who engage Napa Concrete for concrete contractor services. Use of this website constitutes acceptance of these terms as they exist at the time of your visit.
Napa Concrete provides concrete contractor services to residential and commercial customers in Napa, CA and surrounding service areas. Services include but are not limited to: concrete driveway building, patio construction, stamped concrete, sidewalk building, garage floors, decorative concrete, retaining walls, floor installation, pool decks, steps, slab foundations, foundation installation, parking lots, footings, foundation raising, and concrete cutting.
This website is for informational purposes and to facilitate initial contact with prospective customers. No binding service agreement is formed through use of this website alone. A binding agreement requires a written estimate or contract signed by both parties.
All estimates provided by Napa Concrete are free and based on information gathered during an on-site visit or provided by the customer. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
An estimate is not a binding contract. A project does not begin until the customer has reviewed and accepted a written proposal or contract and any required deposit has been received.
Napa Concrete will notify the customer before undertaking any work not covered by the original estimate. Additional work outside the original scope will be priced separately and requires customer approval before proceeding.
Prices on this website, if any, are for general informational purposes only and are not a quote for any specific project. Actual pricing depends on site conditions, project scope, materials, and current labor and material costs.
Project start dates are scheduled after a written agreement is in place and any required deposit is received. Start dates are subject to weather conditions, permit approval timelines, and material availability.Napa Concrete will communicate changes to the schedule as early as possible.
Concrete work cannot be performed safely in rain or when temperatures are expected to drop below 40 degrees Fahrenheit overnight. If weather conditions require rescheduling, Napa Concrete will contact the customer promptly to confirm a new start date. No additional fees are charged for weather-related delays.
Cancellations by the customer after work has begun may result in charges for work completed and materials purchased to that point. Cancellation terms for specific projects are outlined in the written project agreement.
Payment terms for each project are specified in the written project agreement. In general, Napa Concrete requires a deposit prior to scheduling and materials purchase, with the remaining balance due upon project completion unless otherwise stated in the agreement.
Accepted payment methods are specified in each project agreement. Invoices not paid within the time specified in the project agreement may be subject to a late fee as allowed under California law.
Under California law, a contractor may not ask for or accept a deposit of more than 10% of the total contract price or $1,000, whichever is less, before work begins on a home improvement contract. Napa Concrete complies with this requirement.
Napa Concrete is a licensed California contractor and complies with all applicable state and local building codes and regulations. Where required,Napa Concrete will obtain the necessary permits from the relevant local authority before work begins. Permit fees are included in or separately itemized on the project estimate.
The customer is responsible for ensuring that Napa Concrete has lawful access to the property and that any HOA approvals or other third-party approvals required for the project have been obtained prior to the scheduled start date.
Napa Concrete stands behind the quality of its workmanship. Any warranty specific to a project will be stated in the written project agreement.
Concrete is a natural material subject to environmental factors including soil movement, temperature changes, moisture, and load. Minor surface cracking is a normal characteristic of concrete and is not a defect. Structural issues resulting from undisclosed site conditions, improper use, acts of nature, or modifications made by the customer or a third party after project completion are not covered by any warranty.

To the fullest extent permitted by applicable law, Napa Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or the services provided.
Napa Concrete's total liability for any claim arising out of or related to a specific project shall not exceed the total amount paid by the customer for that project. Nothing in these terms limits liability for gross negligence, willful misconduct, or any claim that cannot be limited under applicable law.

If informal resolution is not successful within 30 days, disputes may be submitted to mediation before either party pursues litigation. The cost of mediation will be shared equally by both parties unless a mediator or court determines otherwise.
Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of CA (California), without regard to conflict of law provisions. Any legal action or proceeding arising out of these terms shall be brought exclusively in a court of competent jurisdiction in CA, and both parties consent to personal jurisdiction in that venue.
